Robert A. McKinley is a registered U.S. patent attorney with over 15 years of experience in all aspects of intellectual property (IP) law. His experience includes litigating large scale patent, trademark, and trade secret cases, to patent and trademark procurement, and providing strategic planning, counseling and guidance to clients over a full spectrum of IP issues that arise in the day-to-day corporate world. Mr. McKinley has particular expertise in the electrical and computer arts including telecommunications, business methods, computer hardware and software, analog and digital circuits, power and lighting systems, wireless devices and systems, and medical devices, to name a few.
Mr. McKinley’s litigation practice is founded upon his broad experience in transactional work. He has advised international companies, start-up/growth companies, and universities on patent and trademark filing strategies
, joint development agreements, licensing agreements and acquisitions. Mr. McKinley has a reputation for providing prompt, creative and practical business solutions to a broad range of IP clients when disputes arise. He has served as lead counsel and/or lead IP counsel in patent infringement, trademark infringement, and trade secret theft litigation for over a decade, and has tried cases to verdict in front of judge and jury. He has handled countless depositions of technical experts, legal experts, CEOs, corporate designees and other witnesses all over the world. The centerpiece of his litigation philosophy is to assess the strength of the claims, and counsel clients early on the risks and benefits of moving forward. Mr. McKinley believes that clients at all levels of sophistication and size, value straight talk regarding realistic litigation budgets and defining what “success” truly means in a particular litigation context.

Mr. McKinley served as Chair of the IP department at a general practice firm prior to joining RatnerPrestia. He received his B.S. degree in Electrical Engineering from Drexel University in 1992, and was selected to the National Electrical Engineering Honor Society, Eta Kappa Nu. At Drexel, Mr. McKinley was also awarded the Philadelphia Naval Shipyard Scholarship and worked as a Systems Engineer in both the Design Division and the Combat Systems Office at the Philadelphia Naval Shipyard after graduation. In 1998, Mr. McKinley earned his J.D. from Widener University School of Law, Evening Division, where he received honors in both appellate and trial advocacy.
Mr. McKinley received the "Leaders in Law" Award - Philadelphia Business Journal (2008) – and has been recognized as one of "Pennsylvania Rising Stars" for IP litigation - Law & Politics and Super Lawyers (2006). He has lectured on topics related to IP litigation, due diligence in IP transactions, and steps companies should take to protect their IP; and has authored a chapter on licensing in the book Inside the Minds: Intellectual Property Licensing Strategies 2012 ed. (Aspatore Books, a Thomson Reuters business). Currently, Mr. McKinley is an active member of the American Intellectual Property Law Association and the International Trademark Association. Mr. McKinley is a member of RatnerPrestia's Litigation Group and Trademark Practice Group.
