RatnerPrestia Shareholder Kenneth Nigon Receives the 2012 AIPLA Project Award
Shareholder Kenneth N. Nigon of RatnerPrestia, accepted the 2012 American Intellectual Property Law Association (AIPLA) Project Award at the annual meeting on October 25, 2012. This award recognizes Nigon’s outstanding service to AIPLA, particularly in his service on the America Invents Act Committee of Experts. The Committee of Experts is a group of six attorneys: two from AIPLA, two from the ABA Intellectual Property Law Section, and two from the Intellectual Property Owners Association. Nigon first stepped into AIPLA as the Vice Chair of the Electronic and Computer Law Committee back in 1996. He has also served on the Board of AIPLA as Treasurer. Today, he serves as the Chair of the Patent Law Committee.
The purpose of this Committee of Experts was to determine a common framework for the rules regarding the new post grant proceedings (Post-Grant Review, Inter Partes Review and the Transitional Program for Covered Business Methods) that would be supported by all of the organizations. The committee then drafted a set of model rules which were considered by the USPTO during their initial rulemaking. After the USPTO drafted the proposed rules, the committee provided comments and met with representatives of the USPTO to suggest changes to make the proceedings more fair and easier to use. Many elements of the proposed rules and many of the changes recommended by the Committee of Experts, were in fact implement in the final USPTO rules.
